COMPETITION RULES

 

  1. Definitions

Unless the context provides otherwise, the words and expressions set out below will have the following meanings and cognate expressions shall have corresponding meanings:

  • Promotion” or “Competition” means the Jägermeister Spin the Coin QR CODE promotion starting on 15 April 2022 and ending at midnight on 18 April 2022, organized by the Promoter and open to all people residing in South Africa who are 18 years or older.
  • Promotion Period” means 15 April 2022 and ending at midnight on 18 April 2022.
  • Goods” means any Jägermeister, participating product
  • Participant” means a person who enters the Promotion.
  • Participating Stores” means any retailer or trader of the Goods in the Republic of South Africa which is approved by the Promoter to participate in the Promotion.
  • Promoter” DGB (Pty) Limited, a company duly incorporated in accordance with the company laws of the Republic of South Africa.
  • Prize” means the prizes that can be won in this Competition, as described in clause 5 below.

 

  1. Application of Terms and Conditions

By choosing to enter the Competition, the Participant agrees to be bound by the following terms and conditions, which the Participant acknowledges to have read and understood.

  1. Entry Requirements
    • To be eligible for Participation in this Competition an entrant must:
      • Be a South African citizen or permanent resident over the age of 18 (eighteen).
      • Successfully enter the Promotion in accordance with the entry mechanism set out in clause 3.4; and
      • adhere to the terms and conditions that apply to this Competition.
    • Participants may only enter this Competition by scanning a QR CODE found in approved traders that will displayed on various media. The QR CODE will require the consumer to have DATA loaded on their phone which will take them to a microsite where a consumer journey will be followed and the mini game – Spin the Coin – will be played where a prize of a free SHOT of Jägermeister can be won.
    • Participants may only enter this Promotion in the Republic of South Africa.
    • To enter the Promotion, Participants must:
      • Scan the QR CODE found on various media supplied by the traders of various outlets approved by the promoter.
      • Data will be charged to the consumer engaging with the QR code. *Contact your service provider for individual data rates*
      • Participating products include: Jägermeister Core
    • Detailed mechanic:
      • Entries received through any medium other than the entry pathways QR CODE SCAN stipulated in clause 3.4 entry mechanic shall not be considered.
      • Entrants will be required to complete a consumer journey before playing the game. The consumer journey will require age verification, compliance with POPIA (Protection Of Personal Information Act) Opt-In, Cellphone number and email address.
      • An entrant is required by law to give the promoter permission to capture their personal information. Should they select NO on this screen they will be removed from the promotion.
      • An entrant DOES NOT need to Opt-In. Selecting NO will not remove them from the journey and they will still be eligible to play the game and win the prize.
      • Each verified trader will be given promotional bottles of Jägermeister depending on business size. Each outlet will run the promotion for either: The full duration of the promotional period or until all the promotional bottles have been used. If the promotional bottles are used before the close of the promotional period, the trader will close the promotion in their respective outlet.
      • Whether or not a Participant is an instant winner will be determined by the Promoters random selection system.
      • Any prize not taken up for any reason within twenty four (24) hours of notification shall be forfeited.
      • No entries submitted on behalf of a third party will be accepted.
    • Only entries received within the Promotion Period will be considered. The Competition closes at midnight on 18 April 2022 (the “Closing Date”) and no other entries thereafter shall be considered.

 

  1. Prizes and Award Terms
    • The eligible winners of the Promotion will be chosen by a random algorithm after spinning the coin found within the consumer journey after scanning the QR CODE. The random algorithm will determine if the entrant is a successful winner or not and notify them whether they have or have not won immediately in session.
      • Selected eligible winners of a FREE shot of Jägermeister will show their phone to their waiter to receive their prize.
  1. Use of Personal Information
    • All entrants must confirm that they are over the age of eighteen (18) in order to enter the promotion.
    • To participate in this Competition. As per the LAW and guidelines set out by POPIA, the entrants must give permission for the Promotor to process their personal information. If the entrant selects NO on this screen, they will automatically be notified that they were removed from entering.

  • A Participant may ask the Promoter at any time before the Closing Date to correct or confirm any personal information if it is wrong or out of date.
  • To the extent that elements of the Prizes are being provided by a third party, the personal information of the winners may be passed on to such third party for the sole purpose of prize fulfilment.
  • Each Participant warrants that he/she has the authority to allow the Promoter to use his/her personal information for purposes of the Promotion.
  • The Promoters will not use any Participant’s personal information in any way which breaches the law and undertakes to keep all personal information of Participants secure and for as long as the law requires.
  1. Warranties and Indemnities
    • The Promoter, its employees, officers, directors, agents and associates and the Participating Stores, their employees, officers, directors, agents and associates (the “Indemnified Parties’’) shall not be liable for and the Participants hereby indemnify and hold the Indemnified Parties harmless from any claim, liability, cost, expense or penalty suffered or incurred by any person as a result of participating in the Promotion.
    • All products given as part of the Prizes are subject to all applicable warranties, guarantees and instructions of use accompanying such products.

 

  1. Force Majeure

In the event of any act of God, strike, war, warlike operation, rebellion, riot, civil commotion, lockout, combination of workmen, interference of trade unions, suspension of labour, fire, accident, or (without regard to the foregoing enumeration) of any circumstances arising or action taken beyond or outside the reasonable control of the Promoter preventing them from the performance of any obligation to a Participant (any such event hereinafter called “Force Majeure”) then the Promoter shall be relieved of all such obligations to the Participant during the period that such Force Majeure continues and shall not be liable for any delay or failure in the performance of any obligations or loss or damage which the Participant may suffer due to or resulting from the Force Majeure.

  1. General:
    • The Promoter may in its sole and absolute discretion amend these terms and conditions at any time, by publishing the revised terms and conditions on: https://dgb.co.za/competitions
    • The following persons may not enter the Competition or be eligible to win any of the Prizes:
      • any director, member, partner, owner, employee, agent of, consultant to, or anyone associated with or affiliated to the Promoter; or
      • a supplier of goods or services in connection with the Competition.

  • Prizes are not transferable for cash or any other prizes.
  • The Promoter will not accept responsibility for  entries that are lost, mislaid, damaged, undelivered or delayed in transit, regardless of cause, including, but not limited to, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind.
  • The Promoter reserves the right to disqualify any Participant who breaches any provision of these terms and conditions.
  • In the event of a dispute regarding any aspect of the Promotion and/or these terms and conditions, the Promoter’s decision will be binding and final and no correspondence will be entered.
  • In the event of a dispute regarding an eligible winner chosen in accordance with 4.1 above, the decision of an independent admitted attorney duly appointed by the Promoter will be final and binding and no other correspondence will be entered.
  • The Promoter reserves the right to cancel, suspend, amend, or terminate the Competition at any time and without notice to the Participants.

The Promoter will never ask you to provide banking details to take part in a Promotion or Competition.

  • Nothing in these terms and conditions is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the participant or the Promoter in terms of the Consumer Protection Act, 68 of 2008 (“CPA”).
  • By entering the Competition, entrants acknowledge that the Competition will be managed in accordance with the provisions of the CPA. Qualifying entrants undertake to expeditiously do all things necessary to enable the Promoter to comply with their obligations under the CPA.
  • Entering this Competition constitutes the unconditional acceptance of these terms and conditions.

COMPETITION RULES

  1. This Promotional Competition (the “Competition”) is organized by DGB (Pty) Limited and/or their designated agencies (the “Promoter”).
  1. The Competition is open to Participants who are permanent residents and citizens of South Africa over the age of 18 (eighteen) years, in possession of a valid South African Identity Document to qualify as a Participant for the Competition (referred to as “Participants/Entrants”).
  1. Any employee, director, member, partner, agent or consultant or any person directly or indirectly who controls or is controlled by the Promoter and/or immediate family members of any employee, director, member, partner, agent or consultant of or person indirectly or directly in control or controlled by the Promoter, its advertising agencies, advisers, dealers, suppliers and bottlers of beverages identified by the trademarks owned by or licensed to DGB its affiliates and/or associated companies are not allowed to enter the Competition (“Disqualified Participants”).
  1. By entering the Competition, all Participants and Winners, agree to be bound by these rules as interpreted by the Promoter, whose decision regarding any dispute will be final and binding. The Promoter reserves the right at any time without notice to amend, modify, or change these rules, and to postpone, suspend or cancel this Competition and any prizes (which have not yet been subject to a draw), or any aspect thereof, without notice at any time, for any reason which the Promoter reasonably deems necessary.
  1. The Competition commences on 1 November 2021 and ends 31 December 2021, both days inclusive (“the Duration”).
  1. Participants stand a chance to win one of the following: (herein referred to as “Prizes”)

  1. To stand a chance of winning one of the Prizes, participants must:
  • Purchase a participating Jägermeister 750ml. (Herein referred to as “Participating Products”) from participating stores

  • Entry is via USSD. Dial *120*5010# and follow the prompt. Cost per entry is 20c per 20 seconds
  • Participants must keep their till slip as proof of purchase
  • Follow the prompts to complete their entry; (herein referred to as an “Entry”)
  1. Participants may enter the Competition as many times as they wish over the Duration, provided they purchase a Participating Product for each Entry in terms of Rule 7 above and complete all the Entry steps set out in Rule 7.1, 7.2, 7.3 and 7.4 above.
  1. Prize Rules
  • All competition prizes are neither transferable nor redeemable for cash. The promoter reserves the right to substitute Prizes with any other prize of comparable commercial value.
  • Prize images on the Point of Sale promotional material are used to represent the prizes for illustration purposes only and might differ from the actual prizes awarded
  • All Prize Winners will be determined by random automatic selection draw on the following draw dates.
  • The Promoter will call the possible Winner and conduct a Competition verification process (“Verification Process”).
  • The Verification Process will consist of the following:
  1. All the Competition Prizes are neither transferable nor redeemable for cash and the Promoter is not liable for any defect in the Prizes. The Promoter reserve the right to substitute Prize with any other prize of comparable commercial value.
  1. In addition to any other the verification requirements set out in these Rules, the Promoter may require the Prize Winners to complete and submit an information disclosure agreement and indemnification, as well as supply a copy of their valid Identity Document within 24 hours of being confirmed a Winner, to enable the Promoter to ensure compliance with these rules and the Consumer Protection Act 68 of 2008. Should any Winner refuse or be unable to comply with this rule for any reason, such Winner will be deemed to have rejected the Prize and it shall revert back to the Promoter.
  1. The Promoter may require the Prize Winners to be identified and photographed and the photographs published in printed media, or to appear on radio and television, when accepting their Prize and/or after having received their Prize. The Winners and/or their Travel Partner will be given the opportunity to decline to the publication of their images and to participate in the Promoters’ marketing material in so far as it relates to the Competition.
  1. No liability shall attach to the Promoters in relation to any claims, losses or liabilities for any loss of profit or any other direct and/or indirect, special or consequential loss arising out of any of the Prize. The Promoters are not liable for any defects in the Prize. Ownership of and risk in, and benefit attaching to, the Giveaways will pass to you immediately.
  1. Should any dispute arise in relation to the interpretation of these competition rules, the Promoters’ decision shall be final and no correspondence shall be entered into.
  1. All Participants, and the Winners, as the case may be, indemnify the Promoters, their advertising agencies, advisers, nominated agents, suppliers and Bottlers of beverages identified by the trademarks owned by or licensed to DGB (pty) Ltd, its affiliates and/or associated companies against any and all claims of any nature whatsoever arising out of and/or from their participation in any way howsoever in this Promotion including, as a result of any act or omission, whether as a result of negligence, misrepresentation, misconduct or otherwise on the part of the Promoters and/or use of the Prizes).
  1. The Promoters may require the winners to complete and submit an information disclosure agreement and indemnification to enable the Promoters to ensure compliance with these Rules and the Consumer Protection Act 68 of 2008. Should any winner refuse or be unable to comply with this rule for any reason, such a winner will be deemed to have rejected the Giveaway and it shall revert back to the Promoters.
  1. The Promoters may require the winners to be identified, photographed and published in printed media, or to appear on radio and television, when accepting their Giveaways or after having received their Giveaways. The Promoters may also use the uploaded images in whole or in part, and any reproductions thereof, worldwide for advertising, promotion, publicity or otherwise on any website for any media purpose and for any other lawful purpose whatsoever. The winners will be given the opportunity to decline to the publication of their images and to participate in the Promoters’ marketing material in so far as it relates to the Promotion.
  1. By entering the Competition, the Participant agrees that DGB and its affiliates (including the Promoter, subsidiaries, bottlers, and joint ventures) may contact the Participant via email and through social media platforms to deliver marketing communications regarding their products and promotional activities. provided that the Participants are given the opportunity to opt-out of receiving marketing communication at any time via the appropriate opt-out mechanisms provided by the Promoter for such

  • No computer-based entries will be accepted; and
  1. Entries that are unclear, illegible, are submitted via an incorrect entry mechanism or contain errors or from Disqualified Persons will be declared
